3. Application and Approval Process

Application Submission

When you submit a funding inquiry or application, you agree to provide accurate, complete, and current information. Providing false or misleading information may result in denial of your application or termination of any existing agreement.

Credit and Background Checks

By submitting an application, you authorize ADFG LLC to obtain credit reports, financial records, and other information necessary to evaluate your application. This may include, but is not limited to:

• Personal and business credit reports
• Bank account verification
• Business verification and background checks
• Tax return and financial statement review

No Guarantee of Approval

Submitting an application does not guarantee approval or funding. ADFG LLC reserves the right to approve, deny, or modify any funding request at our sole discretion based on creditworthiness, business viability, and risk assessment.

4. Loan Terms and Agreements

If your application is approved, the specific terms of your loan, including:

• Principal amount
• Interest rate or factor rate
• Repayment schedule and frequency
• Fees and charges
• Default provisions

will be provided in a separate Loan Agreement or Financing Agreement. You must review and sign this agreement before funds are disbursed. The terms outlined in your individual Loan Agreement will govern your specific transaction and may differ from the general information provided on this website.

5. SMS Terms & Conditions

Program Description

ADFG LLC offers an optional SMS messaging program to provide you with updates, offers, and information about our business funding services. By opting in, you agree to receive recurring marketing and promotional SMS/MMS messages, which may be sent using an automated telephone dialing system (ATDS).

Consent and Opt-In

Participation in the SMS program is voluntary. By providing your mobile phone number and expressly consenting to receive text messages, you authorize ADFG LLC to send you recurring SMS/MMS messages to the mobile number provided.

Consent is NOT a condition of purchase or service. You are not required to consent to receive text messages to apply for or receive business funding from ADFG LLC.

Message Frequency

Message frequency varies. You may receive up to 4 messages per month. The actual number of messages depends on your account activity, inquiries, and promotional campaigns.

Message and Data Rates

Message and data rates may apply. Standard text messaging rates from your wireless carrier will apply to all SMS messages sent to and from ADFG LLC. Please consult your mobile service provider for details on your messaging plan.

Opt-Out Instructions

You may opt out of receiving SMS messages at any time by replying STOP to any text message you receive from us. Upon receiving your opt-out request, we will send you a confirmation message and cease sending further messages. If you wish to re-subscribe later, you may opt in again through our contact form or by texting START.

Supported Carriers

Our SMS program is compatible with most major U.S. wireless carriers. While we strive to support all carriers, message delivery is not guaranteed on all networks. Carriers are not liable for delayed or undelivered messages.

Privacy

Your mobile phone number and opt-in information are governed by our Privacy Policy. We do not share your mobile information with third parties for their own marketing purposes.

6. Fees and Charges

ADFG LLC may charge fees in connection with our lending services, including but not limited to:

• Origination fees
• Processing or underwriting fees
• Late payment fees
• Prepayment penalties (if applicable)

All fees will be disclosed in your Loan Agreement before you accept funding. You are responsible for reviewing and understanding all fees associated with your loan.

7. Repayment Obligations

Once you accept funding from ADFG LLC, you are legally obligated to repay the loan according to the terms outlined in your Loan Agreement. This includes:

• Making timely payments on the agreed schedule
• Maintaining sufficient funds in your designated bank account for ACH withdrawals
• Notifying us immediately if you are unable to meet payment obligations

Failure to repay your loan may result in:

• Late fees and penalties
• Negative reporting to credit bureaus
• Legal action to recover outstanding debt
• Collection efforts, which may include third-party collection agencies

8. Use of the Website

Permitted Use

You may use the Site for lawful purposes only. You agree not to:

• Use the Site to transmit any unlawful, harmful, or offensive content
• Interfere with or disrupt the Site's functionality or servers
• Attempt to gain unauthorized access to our systems or user accounts
• Use automated tools (bots, scrapers) to access or extract data from the Site
• Misrepresent your identity or affiliation

Intellectual Property

11. Governing Law and Dispute Resolution

These Terms and any disputes arising from or relating to them shall be governed by the laws of the State of New Jersey, without regard to its conflict of law principles.

Arbitration

Any dispute, claim, or controversy arising from or relating to these Terms or your use of our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in Monmouth County, New Jersey, or another mutually agreed-upon location.

You agree to waive your right to a jury trial and to participate in any class action lawsuit or class-wide arbitration.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
